IDEA vs. 504

This isn't about Kayla, but about Laurie. She has behavioral/anxiety/emotional/social issues, but is academically gifted. I really don't think that she needs to go through the whole IEP process, so should I go with a 504 plan?

She will be moving from private Montessori to the public elementary school. She already sees the social worker at the public school (bussed there once a week). Don't care much for her IEP goals, since her problematic behaviors seem to change on a monthly basis (one month it's not playing with kids, the next it's crying all the time, the next it's being afraid of everything).

I would think that if she is being disruptive in class next year, the teachers would just send her to the social worker. Maybe just have a behavioral intervention plan instead of all the paperwork with an IEP.

Any suggestions?

Where we are, the school is reluctant to use a 504 plan, and it is really at the whim of the principal. If you think she has special needs I would go for an IEP under the IDEA instead--that is legally enforceable. Remember you can call new IEP meetings as circumstances change, so you can have multiple meetings through the year if you need them. Just my own take on the situation.

From my understanding, a 504 just makes modifications for your child's behavior issues. But, an IEP will have goals and modifications, so the teachers will work on those skills. Plus, the special education teacher would work with her and offer the teacher suggestions to help her. I'd go with the IEP.
